The last Will and Testament of John Simpson deceased with the Proofs thereof as a Will of real and personal Estat [sic] Recorded the 26th day of December 1860

Will
In the name of God Amen. I John Simpson of the town of Hoosick County of Rensselaer and State of New York of the age of Seventy Five and being of sound mind and memory do make and publish and declare this my last Will and Testament in manner following that is to say.  I give and bequeath to my wife Margaret C. Simpson and to my son DeWitt Clinton Simpson all of my real estate and all my personal Estate of whatsoever name or nature to be used and injoyed by my wife Margaret C. Simpson and my son DeWitt Clinton Simpson during the natural life of my wife Margaret C. Simpson and at her decease then whole of my real and personal Estate I give to my said son DeWitt Clinton Simpson. and in case my said son DeWitt Clinton Simpson shall die without heirs and before he shall become of age then the whole shall decend to my wife Margaret C. Simpson for and during her natural life and after her decease my real estate is to decend to my heirs.  And I also give to my wife Margaret C. Simpson the right to sell and dispose of all or any part of my personal property for her or my son DeWitt Clinton Simpson use or benefit and I also give to my son Dewitt Clinton Simpson power and right after the decease of my wife Margaret C. Simpson and whenever he shall become of age to sell and convey the whole of my real estate or any part thereof for his sole use and benefit. And I do dispose and commit the tuition and custody of my son DeWitt Clinton Simpson until he shall become twenty one years of age to my wife Margaret C. Simpson.
And lastly I do hereby nominate and appoint my wife Margaret C. Simpson and my son John R. Simpson to be executors of this my last will and testament hereby revoking all former wills by me made In Witness whereof I have hereunto set my hand and seal this Sixth day of July in the year of our Lord one thousand eight hundred and Sixty.

The above instrument consisting of one sheet was at the date thereof signed sealed published and declared by the said John Simpson as and for his last will and testament in presence of us who at his request and in his presence and in the presence of each other have subscribed our names as witnesses thereto
